Kamapla, Uganda : English High Court has rejected an application from Crane Bank Limited (CBL) that aimed to prevent a forensic report by PricewaterhouseCoopers (PwC) from being included in the case against dfcu Bank, representing a notable legal win for dfcu.
In a ruling made by Justice Paul Stanley, it was also ordered that prominent Ugandan businessman Sudhir Ruparelia must hand over his mobile phone for forensic analysis, and his daughter, Sheena Ruparelia, was instructed to provide relevant documents from her personal email account.
This case stems from the contentious acquisition of Crane Bank by dfcu Bank in 2017, which occurred after the Bank of Uganda (BoU) placed CBL into receivership due to insolvency and severe mismanagement issues.
Crane Bank’s legal representatives had attempted to prevent the use of audit reports created by PwC Uganda, contending that the firm was not part of the global PwC network and that the reports should not be considered valid evidence of primary facts.
Nevertheless, the Court dismissed both arguments, confirming that the reports were valid and could be utilized in the current proceedings.
Justice Stanley remarked that the audit, which consists of over 150 pages and examines conduct dating back to the early 2000s, raised significant concerns regarding the management practices at Crane Bank.
